Court adjourns Turaki-Led PDP suit pending appeal
A Federal High Court in Abuja has adjourned hearing in the suit challenging the legitimacy of the Kabiru Turaki-led Peoples Democratic Party (PDP).
The plaintiffs, Mohammed Abdulrahman and another, are seeking an injunction restraining the Turaki-led PDP from parading themselves as representatives of the party in any capacity.
During proceedings, the defence counsel, Chris Uche, applied to withdraw their earlier motion seeking a stay of proceedings. The plaintiffs’ counsel, Onyeachi Ikpeazu, did not oppose the withdrawal. Consequently, the trial judge struck out the application.
Uche further informed the court that the record of appeal had been filed at the Court of Appeal, urging the judge to adjourn the matter until the appellate court determines the appeal. He argued that the trial court lacks jurisdiction to proceed once the record of appeal has been entered.
The plaintiffs’ counsel, Ikpeazu, opposed the request, contending that the defence application was not supported by an affidavit of facts.
After considering submissions from both sides, Justice Abdulmalik agreed with the defence and adjourned the case to February 20, 2026, pending the outcome of the appeal.
